The swimming pool, patio and garden area at 120 Solano Street, Tiburon California (hereafter Pool, Patio and Garden) are exclusively owned and maintained by Joe and Cathy Haraburda (hereafter Owners). The Owners and long-term residents of 110 and 120 Solano Street may use the Pool, Patio and Garden area according to the rules set forth below. Persons occupying the property for a period of less than thirty-one days are not entitled to use the Pool, Patio, or Garden area. To ensure a safe and secure area, cameras monitor the pool and garden.
It must be understood that use of the Pool, Patio and Garden area is a privilege, and that payment of rent or other consideration does not entitle any person to use of the Pool, Patio and Garden area. Each person is responsible for adherence to the Rules set forth below. Owners have the right to ask Tenant(s) to leave for non-compliance with the rules.
Pool and Patio Rules
- The Pool, Patio and Garden are available for use by residents of 110 and 120 Solano Street who have lived at either property for 31 days or longer, and by their personal guests while residents are present. No more than five guests are allowed in the Pool and Patio area at one time. Short-term paying residents (less than 31 days) are not allowed to use the Pool or the Patio.
- The Pool and Patio are available for use between 10:00 am and 8:00 pm seven days a week.
- Swim at your own risk. All persons using the Pool and Patio agree that they bear sole responsibility for all risks of doing so, and will hold the owner and the property harmless in the event of injury, death, illness, etc.
- Pets are not allowed in the Pool, Patio or Garden areas.
- Children under the age of 12 must be supervised by an adult parent or legal guardian at all times.
- Children or others of any age wearing diapers are not allowed in the Pool, for sanitary and health reasons.
- Diving and jumping from or into any part of the Pool is strictly prohibited.
- Running, hazardous activities, and boisterous or rough play, in the Pool and Patio area, are strictly prohibited.
- Spitting, spouting water, blowing the nose, or other bodily discharges, are strictly prohibited in the Pool and Patio area.
- Smoking and vaping are not allowed in the Pool, Patio, or Garden area.
- Glass containers are not allowed in or around the Pool, Patio or Garden.
- Noise and music must be limited to conversational levels in the Pool and Patio area.
- Pool toys, towels and swimming attire are to be removed from the Pool after use and before leaving the Pool and Patio area.
- Proper bathing attire is required at all times: conventional bathing suits or equivalent. Thongs and other revealing or suggestive attire are not allowed.
- All Patio Furniture is provided by the Owners. Patio Furniture may not be removed from the Patio. No other furniture is allowed in the Patio area. Return Patio Furnishings to their original positions before leaving the Pool and Patio area.
- All eating and drinking materials, and refuse and recyclable materials, are to be removed from the Pool and Patio area before leaving. Refuse and recyclable materials must be deposited into appropriate containers at the home of each user of the Pool and Patio.
- These rules may be updated or changed at any time, at the sole discretion of the Owners.
